Judge Tosses Will Smith Harassment Suit, but Door Still Open

In a legal victory for Will Smith, a judge has dismissed a sexual harassment lawsuit filed by violinist Brian King Joseph—at least for now. Joseph, who toured with Smith in 2025, sued the actor earlier this year alleging that someone entered his Las Vegas hotel room without permission and left a note signed“Stone F.”reading,“Brian, I’ll be back…just us,”along with wipes, beer, and HIV medication. Joseph claimed Smith was grooming him for sexual activity and later terminated him in retaliation for reporting the incident.

But here’s where it gets interesting: the judge didn’t rule that nothing happened. Instead, the court found that Joseph’s complaint failed to meet the legal bar for sexual harassment because it“fails to adequately allege conduct that is sufficiently severe or pervasive.”The judge also noted a critical vulnerability in Joseph’s case—he hadn’t sufficiently proven that only Smith or his management had access to his hotel room. After all, Joseph had left his bag containing his room key in a van with other crew members for a couple of hours before it was returned to him.

That technical gap might seem like a small detail, but in litigation, it’s everything. Without establishing who realistically could have entered his room, Joseph’s entire theory falls apart. Yet the judge gave him a lifeline: the opportunity to amend his complaint and fix the problems that got it tossed. That means this story isn’t over—Joseph can refile with stronger factual allegations, and we could be heading back to court.

What’s clear is that workplace harassment claims live in a gray zone when the evidence is circumstantial. A note, some items left behind, and timing alone apparently don’t cut it legally. Whether Joseph can shore up his case with additional facts remains to be seen, but for now, Smith’s team has won round one.
