Lawsuit Looms: California Hospitals Face Consequences for Keeping Families in the Dark on Deaths

A recent California Assembly Health Committee meeting brought to light a serious issue in the state’s hospitals: families being left in the dark about their loved ones’deaths. Assembly Bill 2598, inspired by a disturbing KCRA investigation, is designed to tackle the appalling practice of failing to notify next of kin after a patient dies. This legislation comes after stories emerged of bodies being left in cold storage, some for months or even years, without families being informed. One particularly heart-wrenching story involved Jessie Peterson, whose daughter’s body was hidden away for nearly a year without notification.

The proposed law aims to mandate hospitals to inform family members promptly, and penalties will be put in place for those that fail to comply—up to $200 per day for each day notification isn’t made, with a maximum fine of $50,000. Assemblymember Maggy Krell advocates for this essential legislation, highlighting that California needs stronger protections to ensure families are treated with respect during their most trying times.

While the California Hospital Association has suggested a few amendments, the bill currently has no registered opposition. Let’s hope this marks a new chapter in patient care and communication, because no one should have to play detective to find out what happened to a loved one!
